Power of Attorney

[DPL III(1):169c - 24 May 1669]

 

To all Christian People to whom these presents shall Come Greet &c Know yea that wee whose names are heerunto anexed or subscribed doe by these presents make Constitute and ordaine and appoint our Trusty and loveing frinds John Tompson John Turner senr: Edward Gray and Benjamine Bartlett Joyntly and severally to be our true and lawfull attorney or Attorneyes and assigne or assignes for us and in our Names, and to our proper use to aske demaund and Receive of and from all and all manor of persons whatsoever all such sume or sumes of Monyes goods or whatsoever is due owing or belonging unto us for and Concerning a tract or tracts of Lands Graunted by the honored Court of this Jurisdiction unto us which was Purchased of the Indian Sachem Josias Wampatuke by Captaine Thomas Southworth; alsoe one Tract or tracts of land graunted unto us by the said Court lying and being neare Namassakesett ponds which was Purchased from the aforsaid Indian Sachem by Major Josias Winslow giveing and by these presents graunting unto our said Attorney or attorneys assigne or assignes our full power and authoritie Concerning the said lands Purchased by Major Josias Winslow and Captaine Thomas Southworth; to proceed according to Law what they have alreddy begun or by arbetration to make a (mall end or issue Concerning any damage or molestation that hath bine done to or upon the aforsaid Lands by any person whatsoever and further to arrest Implead Condemn and Imprison all and every such person or persons that shall molest doe any damage to or owe any thinge for the said lands; and att theire wills and pleasures out of Prison againe to deliver and upon the Receipt of any sume or sumes of mony or goods whatsoever; discharges and sufficient acquittances for us and in our names to make seale and deliver; and one or more Attorney or Attonreys under him or them to make and ordaine; and him and them att his or theire will or pleasure to Revoake or make void holding feirme and stable whatsoever our said Attorney or Attorneyes shall acte or doe or cause to be legally acted or don in or about the aforsaid lands or premises; and to defend all Complaints that are or shalbe made Concerning the said lands or aforsaid premises; In Witnes wherof wee whose Names are subscribed have sett to our hands and this our seale; this twenty fourth day of May one thousand six hundred sixty and Nine

Power of Attorney Reinstated

[DPL III(1):170a - 8 Dec 1669]

 

Wheras divers persons that are Interested in the Lands Purchased by Captaine Southworth and Major Winslow of Josias the Sachem Lying about Namassakett and also Northward towards Mattakeesett ponds; meeting together on the twentyfourth day of May Last did Impower John Tompson Edward Gray Benjamine Bartlett and John Turner senr: or theire Lawfull Attorneyes and agents to acte for and in the behalfe of the propriators in the abovemensioned purchases of land for defence of theire Rights from Incroachment or treaspas and for settlement of theire lines and boundaries or what else might be for the benifitt of the whole; In procecution of which trust some Considerable Charge alreddy ariseth; and Nessesitie apeereth that some should still be Impowered for the ends within mensioned; and occasions of the like Nature in which alsoe further Charge will Nessesarily arise; a generall meeting of the abovesaid propriators being appointed att this time; soe many of us as did then meet (all haveing notice as wee apprehend) doe heerby declare our willingnes and doe desire that the abovemensioned John Tompson etc. should still acte in the premises by vertue of the power frmerly Given them; and for our selves doe heerby Impower them therunto and alsoe doe particularly advise and betrust them for the dispose of some portion of Lands within the aforsaid Purchase to the vallue of twenty pounds or therabouts for the defraying of such Nessesarie Charges as allreddy however further May arise about the premises in witnes wherof wee have heerunto sett our hands this eight day of december 1669
